SHIDA TERMS OF USE

1. SHIDA

SHIDA is a digital platform available through channels including WhatsApp and the Web. It enables users to discover, publish and manage various activities, offers, services and digital interactions.

Depending on available functionality, SHIDA may enable users to search or publish jobs, buy or sell products, offer or find services, make reservations, search for accommodation, use Wewa and access other SHIDA marketplaces and services.

Features may evolve, be added, modified or removed over time.

2. SHIDA User

Each person uses SHIDA through their own user identity.

A user may use SHIDA personally and may also, where authorized, create, join or manage one or more organizations.

Creating or managing an organization does not create a second personal SHIDA identity.

3. Personal SHIDA

Personal SHIDA enables individuals, independent sellers and small service providers to use SHIDA marketplaces and individual-facing functionality.

A user does not need to create an organization simply because they sell products, provide services or publish certain offers as an individual.

Specific conditions may nevertheless apply to particular activities or categories of content.

4. Information Provided by Users

You must provide accurate information and must not knowingly impersonate another person or organization.

You are responsible for the information, content, images, descriptions, offers, listings and other materials that you publish or transmit through SHIDA.

You must have the necessary rights to use and publish such content.

5. Marketplaces and User Interactions

SHIDA facilitates discovery and interactions between users, sellers, service providers, employers, candidates, property owners, establishments and other participants.

Unless expressly stated otherwise, NIHILOBA is not the party providing a product, accommodation, job, service, meal, stay or other offering published by another user or organization.

The relevant parties remain responsible for their own commitments, information, products, services and obligations.

6. Employment

SHIDA may support job publication and application management.

Employers remain responsible for their vacancies, recruitment criteria, selection decisions and obligations toward candidates.

SHIDA is not the candidate's employer unless expressly stated otherwise.

Candidates remain responsible for the accuracy of the information they provide.

7. Products and Services

Sellers and service providers are responsible for their products, services, descriptions, prices, availability, quality, legality and delivery or performance.

SHIDA may facilitate ordering, reservations, communication or other stages of an interaction without automatically becoming the seller or service provider.

8. Accommodation, Hotels and Reservations

Property owners, hotels and other establishments remain responsible for the accuracy of published information, availability, offered terms and performance of accepted bookings or visits.

SHIDA facilitates discovery and digital management of certain interactions.

9. Phone Numbers and Privacy

SHIDA is designed to protect private contact information.

Phone numbers are not displayed publicly on SHIDA.

Your WhatsApp number may be used internally to identify your account and enable SHIDA to operate.

10. Acceptable Use

You must not use SHIDA to:

• impersonate another person or organization;
• knowingly publish false or misleading information;
• organize or facilitate fraud;
• publish or offer unlawful content, products or services;
• harass, threaten or exploit other users;
• misuse or improperly collect personal data;
• bypass security, authorization or access-control systems;
• deliberately interfere with SHIDA's operation;
• use SHIDA in violation of applicable law.

11. Security

You must protect access to your account, phone, WhatsApp and other authentication mechanisms used with SHIDA.

You should inform SHIDA if you suspect unauthorized access or misuse of your account.

12. Moderation, Restriction and Suspension

SHIDA may review, limit, hide or remove content where there is a reasonable risk of fraud, abuse, impersonation, unlawful activity, user harm or serious violation of these Terms.

SHIDA may also restrict or suspend user access where reasonably necessary for safety, service integrity or compliance obligations.

13. Free and Paid Features

Certain SHIDA functionality may be offered free of charge.

Other features or services may be paid.

No paid service should be activated without first presenting the applicable financial terms to the relevant user or organization.

Functionality, prices and commercial conditions may vary by service.

14. Payments

Where SHIDA offers payment functionality, certain payment operations may be performed by third-party payment providers or financial institutions.

Specific payment-service terms apply.

Unless expressly stated otherwise, NIHILOBA does not act as a bank, credit institution or custodian of user funds.

15. Statistics, Estimates and Recommendations

SHIDA may provide statistics, analytics, estimates, recommendations or other decision-support tools.

Unless expressly stated otherwise, these do not constitute legal, tax, financial, accounting or other professional advice and should be independently verified where necessary.

16. Third-Party Services

SHIDA depends on third-party services and infrastructure that may include WhatsApp/Meta, hosting, storage, databases, payment providers and other technical providers.

Availability of certain features may depend on these services.

17. Availability and Evolution of SHIDA

NIHILOBA aims to provide a useful, available and secure service but does not guarantee uninterrupted, delay-free or error-free availability.

SHIDA may evolve to improve the service, add functionality, respond to technical requirements or comply with legal obligations.

18. Intellectual Property

NIHILOBA retains rights relating to SHIDA, including its software, architecture, interfaces, trademarks and materials developed by NIHILOBA.

Users retain rights they hold in their own content.

By publishing content through SHIDA, the user grants NIHILOBA the reasonable technical rights required to store, process and display that content for the purpose of providing the service.

19. Deletion and Ending Use

You may request deletion of certain data or stop using SHIDA through the mechanisms provided.

Certain information may be retained where necessary for legal obligations, security, fraud prevention or dispute management.

20. Limitation of Liability

Each party remains responsible for its own actions in accordance with applicable law.

Any applicable liability limitations, exclusions or caps must be finalized in accordance with the relevant legal framework.

21. Changes to These Terms

NIHILOBA may update these Terms as SHIDA evolves or where legal, technical or commercial developments require changes.

Where a new version requires renewed acceptance, SHIDA may require the user to accept the new version before continuing to use the service.

22. Governing Law and Disputes

Applicable law, competent courts and any dispute-resolution mechanisms must be finalized taking into account NIHILOBA's place of establishment and the jurisdictions in which SHIDA is offered.
